Breaches of EU law and of the rights of LGBTIQ citizens in Hungary as a result of the adopted legal changes in the Hungarian Parliament - The outcome of 22 June hearings under Article 7(1) of the TEU regarding Poland and Hungary (continuation of debate)
Please read the law. ‘Act LXXIX of 2021 on taking stricter action against paedophile offenders and amending certain laws to protect children’ 1. Amendment of Act XXXI of 1997 on the protection of children and guardianship administration Section 1 (1) Act XXXI of 1997 on the protection of children and guardianship administration (hereinafter: of the Gyvt). Under the subheading ‘Purpose and principles of the Act’, the following Section 3/A is added: ‘Section 3/A In the child protection system, the State shall protect the right of children to self-identity corresponding to their sex at birth.’ (2) The following Section 6/A is added to the Child Protection Act: ‘Section 6/A In order to ensure the objectives and rights of the child set out in this Act, it shall be prohibited to make pornographic content available to persons under the age of eighteen, as well as content depicting sexuality for its own sake or promoting or portraying deviation from self-identity corresponding to sex at birth, gender reassignment or homosexuality.’ 3. The following paragraph (1a) is added to Section 8 of Act XLVIII of 2008 on the basic conditions and certain restrictions of advertising activity in the territory of the host Member State: ‘(1a) It shall be prohibited to make available to persons under the age of eighteen any advertising which presents sexuality for its own sake or which promotes or portrays deviation from self-identity corresponding to sex at birth, gender reassignment or homosexuality.’
