Amendment of Act CLXXXV of 2010 on media services and mass media (3) in Section 32, the following paragraph 4a is added: ‘(4a) Programmes which are capable of impairing the proper physical, mental and moral development of children, in particular by having as their defining element the gratuitous depiction of sexuality, pornography and the promotion and display of deviations from self-identity corresponding to sex at birth, gender reassignment and homosexuality, shall not be regarded as public service announcements or public service advertising.’ Section 168/A(1) is replaced by the following: Taking into account the supervisory experience of the previous year, the Media Council shall draw up an annual supervisory plan by 1 December of the year preceding the current year and publish it on its website within fifteen days. When preparing its annual supervisory plan, the Media Council shall pay particular attention to compliance with the provisions on the protection of children and minors. The Media Council shall ensure the consistency of its supervisory plans. Based on the experiences of the first semester, the plans may be reviewed at the end of the semester and, if necessary, may be amended by the Media Council. The Media Council shall publish the amended supervisory plan on its website within fifteen days of the amendment.
